Professor I. Bennett Capers’s article “Policing, Race, and Place,” 44 Harv. C.R.-C.L. L. Rev. 43 (2009) was recently cited in an amicus brief submitted by the ACLU to the Massachusetts Supreme Court in the case Commonwealth v. Martin. The amicus brief asks the Massachusetts Supreme Court to overrule its prior decision in Commonwealth v. Fraser as inconsistent with the Fourth Amendment and Terry v. Ohio.
